BAR ADMINISTRATION DISPUTE - CONFLICT SCHEDULE 'A' - HOURS OF PLAY  

 

1)         TITLE: CARDONALD BOWLING CLUB

The Club shall be called “ CARDONALD BOWLING CLUB “ and the Club premises are situated at Forfar Avenue, Glasgow.

 

2)         OBJECT

            The object of the Club is to play the game of bowls in the spirit of the game.

            Members of each class of membership should make every effort to achieve this object.

 

3)         MEMBERSHIP

Membership of the Club shall comprise ORDINARY, AFTERNOON, HONORARY LIFE, HONORARY LIFE LADY ASSOCIATE, JUNIOR, NON-PLAYING

AND TEMPORARY MEMBERS.

 

( a ) ORDINARY membership consisting of gentlemen only, shall at no time exceed 220 and no person under the age of Sixteen ( 16 ) years shall be admitted.

 

( b ) AFTERNOON membership shall be confined to Ordinary Members who have been Ordinary Members for the previous Five ( 5 ) years who applied to Council and were accepted by Council for transfer to this membership.

They shall have the privileges of Ordinary Members but have no voice or vote in the management affairs of the Club or take part in Ordinary Members Competitions

 

( c ) HONORARY LIFE membership limited to Ten ( 10 ) members shall be confined to Ordinary Members who in recognition of their services to the Club have been proposed by Council and duly elected by the members at the Annual General Meeting (A.G.M.).

No one shall be eligible for such selection unless they have been an Ordinary Member for longer then Ten (10) years.

In further recognition of services rendered to the Club it shall be competent for the Council to recommend to the members at an Annual General Meeting an Honorary Life President and Honorary Life Vice President from the Honorary Life Members, both these offices to be in addition to the Ten ( 10 ) Honorary Life Members.

(i) The Honorary Life President, Honorary Life Vice President and Honorary Life Members shall have all the privileges and voting rights of an

Ordinary Member.

 

( d ) LADY ASSOCIATES membership, limited to 120 Ladies shall be approved for membership by the Ladies Committee, and duly elected by Council.

They shall have no right or interest in the property of the Club or in the management of the affairs of the Club.

They shall have the privilege of using the Clubhouse and play on the greens as shown on separate Schedule (A).

When the limit of membership has been reached, any further applications shall be added to a waiting list and taken in rotation.

However, applications from near relatives of an Ordinary Member shall have priority over all others.

 

( i ) HONORARY LIFE LADY ASSOCIATE membership limited to Five ( 5 ) ladies, shall be confined to Lady Associate Members recommended by the Ladies Committee in recognition of services rendered to the Ladies Section and approved at the Ladies Annual General Meeting.

No ladies shall be eligble for such selection unless they have been a Lady Associate Member for longer then Ten ( 10 ) years.

In further recognition of services rendered to the Ladies Section it shall be competent for the Ladies Committee to recommend to their members at the Ladies Annual General Meeting an Honorary Life President and Honorary Life Vice President from the Honorary Life Members.

They shall have all the privileges of the Lady Associate Members.

 

            ( e ) JUNIOR membership shall be restricted to those of Ten ( 10 ) years of age to Sixteen ( 16 ) years of age.

They shall have no rights or interest in the property of the Club nor voice or vote in the management affairs of the Club.

On reaching Eighteen ( 18 ) years of age Junior members who have been Junior members for Two ( 2 ) years or more shall become eligble for immediate

admission to the appropriate category of adult membership.

 

( f ) NON PLAYING membership shall be confined to Ordinary or Afternoon members who have been members for the previous Five ( 5 ) years,

who apply to and are accepted by the Council for transfer to this membership.

They shall have no rights to play on the Greens at any time nor have a voice or vote in the management’s affairs of the Club, but otherwise shall enjoy the

privileges of Ordinary Membership.

 

( g ) TEMPORARY membership shall be confined to members of visiting teams for the duration of their stay on the occasion of matches or competitive games

with other Clubs provided their names are displayed in a conspicuous place on the Club premises.

 

4)         ADMISSIONS  (top)

            The name and address of every candidate for admission as an Ordinary Member of the Club must be filled in on the form prescribed by Council

            signed by the applicant and attested by the signature of his proposer and seconder to whom the candidate must be personally known.

The form duly completed shall be displayed on the notice board or other conspicuous place in the Clubhouse for at least Two ( 2 ) weeks after receipt of

application and for a further Two ( 2 ) weeks prior to election during which time any objections by Club members must be lodged in writing with the

Honorary Secretary.

On election to membership, the Honorary Secretary shall inform the applicant in writing within 28 days of the election giving notice of the

Joining Fee and Annual Subscription to be paid ( see also Rule 5 ).

The council may reduce the amount of subscription due in proportion to the date of admission.

Any change of address must be notified in writing to the Honorary Secretary.

 

( a ) The applicant shall not become a member or be entitled to the privileges of the Club until such Joining Fee and Annual Subscription have been paid.

 

            ( b ) An Ordinary Member who must have been an Ordinary Member for 2 years or more can only propose one applicant for Ordinary Membership during the year

            and also second one applicant for Ordinary Membership during the year.

 

( c ) All applicants for membership shall be elected by the Council who shall have full powers to reject any application for membership without reason being given.

Notice of rejection shall be intimated to the proposer and seconder.

 

 

5)         JOINING FEE AND ANNUAL SUBSCRIPTION  (top)

            New applicants for membership to the Club shall on being accepted for membership pay a Joining Fee at a level agreed by Council and approved at the A.G.M.

            This shall be in addition to the Annual Subscription.

            Both monies must be paid before an applicant’s membership is confirmed.

 

( a ) Annual Subscription shall be fixed at the A.G.M. for each class of membership and shall be payable in advance not later than 30th April each year.

Any member failing to pay his Annual Subscription shall cease to have any rights to play on the Greens or take part in Club Competitions or matches until such subscription is paid.

Furthermore, any member who without reasonable cause has failed to pay his Annual Subscription by 30th May shall be deemed to have terminated his membership of the Club.

 

 

6)         BUSINESS AND AFFAIRS OF THE CLUB  (top)

The business and affairs of the Club shall be under the management of a Council consisting of President, Vice President, Immediate Past President,

Honorary Secretary, Honorary Match Secretary, Honorary Treasurer, Honorary Greens Convener, Honorary Social Convener, Honorary Bar Convener,

Honorary House Convener and nine directors.

 

( a ) The Council shall have full powers to hold all the property and transact all the business of the Club, regulate the use of the Clubhouse and Greens

and appoint committees for the performance of specific duties delegated to them by the Council.

All action taken by these committees shall be subject to approval by the Council.

The President, Vice President and Honorary Secretary shall be ex-officio members of all committees.

The President, Vice President, Secretary and Treasurer from time to time shall be the Trustees of the Club.

The heritable property of the Club shall vest in these office bearers as Trustees.

The Trustees shall, on being duly authorised by the Club in General Meeting, have the power to borrow monies, sell, purchase or grant security over

the heritable assets of the Club.

 

( b ) The Honorary Secretary shall convene all meetings of the Club and of Council, minute proceedings, conduct correspondence, keep a complete record of the names and addresses of all members and generally conduct the business of the Club in accordance with the Constitution and the directions of the Council.

He shall submit a report to the A.G.M. which shall be minuted.

 

( c ) The Honorary Match Secretary shall convene all meetings of the Match Committee, keep a record thereof and undertake the arrangement of all matches, games and competitions.

He shall submit a report to the A.G.M. which shall be minuted.

 

( d ) The financial year of the Club shall close on the last day of December.

The Honorary Treasurer shall, after due authorisation by the Council, receive and disburse all monies due to and by the Club and in particular shall collect subscriptions from members.

He shall keep correct accounts and books showing the financial affairs and intromissions of the Club and shall submit annually to the A.G.M. in February

a complete financial statement made up to the end of the year preceding the meeting, previously approved by Council and duly audited.

Such financial statement shall, with the Auditors’ Certificate, be printed in the circular calling the Annual General Meeting.

He shall produce at any meeting of the Club or Council, when called upon to do so, the Club’s books, records, bank books, cash in hand and/or securities

in which the Club’s funds are invested.

 

( e ) Funds of the Club shall be lodged in an approved Bank in the name of the Cardonald Bowling Club and intromissions thereon shall be by any two of the following Office-Bearers,

viz: President, Honorary Secretary, Honorary Bar Convener and Honorary Treasurer.

Any funds invested shall be in the joint names of these three Office Bearers or their successors in office.

 

( f ) The Honorary Auditors, two in number, appointed at the Annual General Meeting, and not members of Council, shall audit the Club accounts and report their findings to the Annual General Meeting.

 

( g ) Council Meetings shall be held at least once a month, July excepted, during the year.

They may also be convened at any time by the Honorary Secretary at the instance of the President or any four members of Council, when the business to be discussed must be stated.

 

( h ) The Annual General Meeting of the Club shall be held in February on a date to be fixed by Council.

The Honorary Secretary shall give notice of this meeting to the members, by circular, at least 7 days prior to the date of the meeting.

The circular shall contain the Honorary Treasurer’s financial statement, the Honorary Auditor’s report, all proposed amendments to the Constitution and Rules,

all motions affecting the finance or property of the Club, particulars of which have been submitted to the Honorary Secretary in writing by the 15th January,

and details the order of the business to be transacted.

 

( j ) Special General Meetings of the Club may be convened at any time on the Council’s instructions.

The President shall be bound to summon and hold a Special General Meeting within 42 days after receipt of a requisition to do so signed by at least 20 members and containing the purport of the business to be considered.

The notice calling such a meeting shall state the business.

 

( k ) The Chairman at all meetings of the Club or Council shall be the President, Vice President or Immediate Past President, whom failing, such other member as the meeting may appoint.

 

( l ) At all General Meetings of the Club, Fifty ( 50 ) voting members shall form a quorum, Seven ( 7 ) shall form a quorum at meetings of Council

and Three ( 3 ) in the case of all committees.

At all meetings the Chairman shall have a casting vote in addition to a deliberate vote.

 

( m ) The property, effects and funds of the Club shall belong equally to the voting Members, who shall be liable equally for the debts and obligations of the Club.

The Club is a non-profit making organsiation, all profits and surplus will be used to foster and promote bowling, no profit or surplus will be distributed other than to another non-profit making body or to members on winding up or dissolution of the Club.

The rights and interests of every voting member shall be personal and shall expire with his membership, and shall not be assignable or arrestable or pass to his executors.

 

7)         NOMINATIONS FOR OFFICES AND DIRECTORS  (top)

 

All nominations for Offices and Directors signed by at least two members must be submitted in writing to the Honorary Secretary not later than 15th January,

and will be included in the notice calling the A.G.M.

 

( a ) The President and the Vice President shall be elected at the A.G.M.

The immediate Past President on retiral shall not be eligble for election to the Council as a Director until the lapse of one year.

 

 

 

( b ) The Honorary Secretary, Honorary Match Secretary, Honorary Treasurer, Honorary Greens Convener, Honorary Social Convener, Honorary Bar Convener

and Honorary House Convener shall retire annually but shall be eligble for re-election at the A.G.M.

 

( c ) The Directors shall be elected by the general body of members at the A.G.M. and shall hold office for three years.

If, however, at any such meeting there are more than three vacancies then three candidates with the greatest number of votes shall be elected for the said period and the remaining vacancies for two years and/or one year shall be filled by the candidates next in order of votes.

Directors who have served for such period of three years shall not be eligible for re-election as Directors until after the lapse of one year.

 

( d ) The Council shall have full power to fill any vacancy on the Council occurring between the Annual General Meetings for the remainder of that year.

 

8)         RESIGNATIONS  (top)

 

Resignations may be intimated in writing to the Honorary Secretary by members at any time provided their subscriptions have been paid.

 

9)         SUSPENSION & EXPULSION  (top)

 

            It shall be competent for the Council to suspend from membership of the Club any member who has been guilty of conduct which,

            in the opinion of the majority of those present and voting at such Council meeting, shall justify suspension and their finding shall be reported to the first

            General Meeting of the Club which shall then decide what further action is to be taken.

Such General Meeting shall, by a majority of those present and voting, by ballot, have power to expel the member.

 

10)        COMPLAINTS & SUGGESTIONS  (top)

 

            Complaints and suggestions shall be made in writing to the Honorary Secretary who shall bring them before Council at its next meeting so that such action

            as considered necessary may be taken.

 

( a ) Where a personal complaint has been made against or by a member of Council, then that member of Council will be debarred from taking part in the   

discussions concerning the complaint and in the final disposal of the complaint.

 

11)        BAR ADMINISTRATION  (top)

 

 The BAR shall be administered by the Bar Committee under the charge of the Bar Convener who shall be responsible to Council for all matters

 pertaining thereto.

 Stock must be taken once a month and a financial statement rendered at the monthly meeting.

 

 ( a ) No exciseable liquor shall be sold or supplied in the Club premises for consumption off the premises except to a member of the Club in person for  

 consumption by him, and specially authorised by Council.

 No liquor shall be supplied to any person under 18 years of age.

 No exciseable liquor shall be brought in and consumed on the Club’s premises except on special occasions and with the consent of Council.

 No member of Council or any manager or servant employed in the Club shall have any personal interest in the sale of exciseable liquor therein or from

 the profits arising from the sale.

 The bar shall be operated in accordance with the terms conditions and provisions laid down in the Licensing ( Scotland ) Act, 1976, or any amendments thereto.

 The hours during which exciseable liquor may be sold subject to the foregoing Acts will be decided by the Council.

 

12)         VISITORS  (top)

 

 Each member shall have the privilege of bringing 3 visitors to the Club premises occasionally, but it is expected that no member will abuse this privilege.

 

 ( a ) Council at their discretion may permit a member to bring more than three ( 3 ) visitors to the Club premises on special occasions.

 In unforeseen or extenuating circumstances, this permission may be granted by an individual member of Council.

 

 ( b ) Visitor(s) shall not be supplied with exciseable liquor in the Club premises unless on the invitation and in the company of a member.

 

 ( c ) The member shall on the admission of such visitor(s) to the Club premises enter his own nameand the name and address of the visitor(s) in a book

 which shall be kept for this purpose and which shall show the date of such visit.

 

 ( d ) A member shall be held responsible for his visitor’s demeanour within the Club.

 When the member leaves the club premises his visitor must also leave.

 

13)         PLAY ON THE GREENS  (top)

 

             Time of play on the greens for all members shall be as stated in the separate Schedule A.

 

             ( a ) Play on the greens shall be subject to the Laws of the International Bowling Board.

 

14)         AMENDMENTS AND ALTERATIONS  (top)

 

             The Council shall have power to make or amend Bye-Laws and Schedules consistent with the foregoing Constitution and Rules but such

             Bye-Laws or Amendments may be annulled or amended at any General Meeting of the Club.

 

             ( a ) Alterations to the preceding Constitution and Rules can only be made at an A.G.M. or Special General Meetin of the Club.

             In the case of proposed alterations at an A.G.M. written notice must be given to the Honorary Secretary by 15th January.

 No alterations shall be made to the Constitution and Rules unless two thirds of the members present and voting are in favour of the changes.

 

 ( b ) Except for temporary emergency reasons decisions made by a majority of the members at a General Meeting can be altered only by a majority vote

 at a subsequent Annual General Meeting.

 

15)         DISPUTE / CONFLICT  (top)

 

              Any dispute or conflict in this Constitution, Rules and Bye-Laws and individual separate parts.

              Schedules, the Constitution, Rules and Bye-Laws shall always prevail.

 

16)          CONSTITUTION, RULES , BYE-LAWS & SCHEDULES  (top)

 

  The foregoing Constitution, Rules and the Bye-Laws and separate parts / Schedules following hereon are binding on every member of the Club in all respects.

 

                                               

  BYE – LAWS

 

1)           In the absence of the Greens Convener any two members of the Council shall have the power to open the Greens or close the Greens

              if in their opinion it is advisable to do so.

 

2)           The Greens, or as much of them as required, may be reserved by the Council for competitions and / or matches.

              No member shall have the right to use any portion of the space so reserved unless he is taking part in those competitions or matches.

 

3)           Five rinks on each green from the commencement of the competitions up to the end of June; four rinks on each green during the period 1st July to 15th July;

              three rinks on each green during the period 16th July to end of August, shall be reserved for Club ties up to 7.00 pm each evening, excepting Mondays,

              Fridays, Saturdays and evenings when inter Club matches or representative games are being played.

              Further Club ties shall be allowed to start on the remaining rinks if unoccupied after 7.00 pm.

 

4)           Should all the rinks in each green be occupied, Members waiting for a game shall have the right to call upon any rink which has not eight players

              to make up to that number, and where there is more than one such rink, a ballot shall, if necessary be taken to decide which rink, or rinks, shall be increased.

              This does not apply to the rinks occupied by Club ties, or for matches or for rinks reserved by decision of Council.

 

5)           Any member of Cardonald Bowling Club who is entered for any competition of any othe Glasgow Outdoor Bowling Club shall not be eligible to enter the

              equivalent competition in Cardonald Bowling Club.

 

6)           All notices and other documents shall be placed on the Notice Board or in the Clubhouse by the Office Bearers or Conveners of Committees only.

              Any member defacing, destroying or removing any such notice shall be dealt with under paragraph 9 of the Constitution and Rules.

 

7)           The greens shall be open to male visitors accompanied by members, but no visitor shall be allowed to play in a Members game unless there is a vacancy.

 

8)           The sanction of the Match Committee is required by a Member desiring the use of a rink, or rinks, for a private game, and applications in writing must give

              at least two days notice. This privilege shall be available from 1st July only.

              Members granted this privilege shall accept unconditionally the rink, or rinks, allocated and in the manner set out by the Match Secretary.

              Not more than two rinks shall be allocated at any one time.

 

9)           No person shall be allowed on the greens unless wearing Regulation Bowling Shoes.

 

10)         Members must exercise all care to avoid damage to greens, banks and other property of the Club.

              Any member who after being cautioned, continues with such damage shall be dealt with under paragraph 9 of the Constitution and Rules..

 

11)          The Club shall not be responsible for the personal property of any member or visitor.

 

12)          Any disputes arising between members shall be submitted in writing to the Council, whose decision shall be final and binding.

 

13)          No member participating in any game of bowls shall leave same unfinished for the purpose of consuming exciseable liquor in the Clubhouse unless

              with prior sanction of the Council.

 

14)          A copy of the Constitution, Rules, Bye-Laws and separate parts/Schedules shall be retained in the Clubhouse and be available to members.

 

15)          A list of members and their addresses shall be kept by the Honorary Secretary.

N.B. In the period between ‘Finals Day’ and ‘Closing Day’ all restrictions regarding Times of Play will be lifted and the greens

be made available for ALL classes of bowling membership.

 

The Council shall have the power to restrict number of rinks available for ALL classes depending on circumstances.
